Miet- und Zahlungsbedingungen für die Mietobjekte Seehütte Neusiedlersee, Romantika 1 und 2, 7071 Rust durch die Vermieterin Laila Suppan-Dado, Lichteneckergasse 11, 2511 Pfaffstätten

Diese Reservierungsbedingungen betreffen die Vermietung der Seehütten und regeln das Rechtsverhältnis zwischen dem Vermieter und dem Mieter der Hütten. Die im folgenden dargestellten Vermietungsleistungen der Hütten werden ausschließlich zu den gegenständlichen Reservierungsbedingungen angeboten. Mit Abschluss einer Buchung bestätigt der Mieter, dass er die Reservierungsbedingungen gelesen und verstanden hat und diesen zustimmt. Der Vermieter behält sich jedoch das Recht vor, die Reservierungsbedingungen zu ändern, und an die gesetzlichen Bestimmungen anzupassen.

Zustandekommen der Vereinbarung/Buchung:

1. Upon receipt of the booking confirmation, the tenant must pay the rental price according to the chosen payment method. A deposit of 40 is % due upon booking. The remaining payment is due 45 days before arrival. If the booking and arrival are less than 45 days apart, the entire amount of the trip will be charged. If payment is not received within this agreed period, the landlord has the right to rent the property to another tenant without further notice.

3. Die bzw. der Mieter erklärt sich mit der Buchung auch einverstanden, die Meldedaten für das Gästeblatt auszufüllen und abzusenden. Hier wird auf die untenstehende Datenschutzerklärung verwiesen.

Mietpreise Ferienhaus Neusiedlersee
Mietpreise, Saisonzeiten und Mietzeiträume sind online beschrieben und verbindlich, die Preisnennung bezieht sich auf jeweils einen Mietzeitraum. Für Schäden im/am Haus, Terrasse oder Boot, die während des Vermietungszeitraums auftreten und vom Mieter zu vertreten sind, haftet der Mieter in vollem Umfang, auch dann, wenn keine Kaution eingefordert wurde. Gleiches gilt für fehlendes Inventar (im Vergleich zur Inventarliste). Die Inventurliste liegt in der Seehütte auf und gilt, wenn nicht innerhalb des ersten Tages widersprochen wird, als verbindlich und vollständig akzeptiert.

Urlaub mit Hund – Kaution für Hunde

When booking with a dog, a registration fee and payment for the dog are required. The tenant is liable for any damage caused to the house, boat, inventory, or excessive dirt or increased cleaning costs (e.g., due to non-compliance with the house rules for dogs). The tenant is fully liable for any damage within the house/on the terrace or boat that occurs during the rental period, and for any greater damage. Any damage caused by the tenant or missing furnishings or other inventory will be charged to the tenant. An inventory list is available in the cabin and is considered accepted if this is not contradicted on the day of arrival. 

Ferienhaus Neusiedlersee – Leistungen

Der Mietpreis schließt folgende Leistungen des Vermieters ein:
1. Überlassung des Mietobjektes zur Nutzung während der Mietdauer.
2. Überlassung von Bettwäsche, Hand- und Duschtücher, Geschirrtücher während der Mietdauer zur Nutzung in den Räumen des Ferienhauses.
3.  Anteilige Energiekosten (Wasser, Strom, Heizung, Klimaanlage usw.) für die Dauer der Miete durch den Mieter.

Belegung des Ferienhaus Neusiedlersee

The holiday home is rented for an occupancy of up to 5 people. The bringing of a dog is absolutely only permitted by agreement and against payment. Sleeping places under the roof are only accessible via a ladder and are therefore not suitable for people with reduced mobility. Access to the holiday home is via a bridge with approximately 10 steps. In the event of unauthorized overbooking, the landlord may terminate the agreement without notice and without compensation and retain the paid rental price. Please note that guests without agreement with the landlord are not allowed to stay in the holiday home. Similarly, bringing pets without agreement with the landlord is a reason for immediate termination of the agreement.

Aufsichtspflicht

The tenant is informed that the kitchen, living area, 1 bedroom and bathroom with toilet are located on the ground floor of the holiday home. The shower at Seehütte 13 is located in the outdoor area. The upper beds can only be reached via a ladder and are not recommended for children or people with reduced mobility. The landlord generally excludes all liability.

Ferienhaus Neusiedlersee mieten – Hausordnung

The tenant keeps the rental property in a tidy condition and pays special attention to ensuring that the trash is regularly disposed of in the designated trash cans (The description of the trash disposal site is included in the house rules, which will be sent out before the start of the rental). The tenant leaves the rental property tidy and cleaned of trash and used dishes. Smoking is strictly prohibited within the vacation home; smoking is allowed on the terrace using ashtrays. It is not allowed to tip or throw ashes onto the property or into the lake. Bringing dogs or pets into the property is generally prohibited and only possible after prior arrangement. Should the tenant violate the pet ban and this only become known after the departure, a flat-rate fee of € 300 will be charged for the increased cleaning costs, replacement of the bedding, etc. The customary rest periods must be strictly adhered to by the tenant and their companions, as well as by their guests. Rest hours are from 22:00 to 07:00. Any disturbance such as parties, celebrations, or noise is expressly prohibited. Any cancellation of the reservation/rental agreement will result in the landlord retaining the agreed rental price. This also applies to early departure. In this case, the reasons for the non-arrival are irrelevant. Accordingly, the landlord points out a travel cancellation insurance. The insurance must be taken out with an insurance company of the tenant’s choice. The tenant must be able to provide proof of a household insurance and confirm this by accepting the booking. This also applies to early departure. In the event of the tenant’s cancellation, the landlord has a flat-rate claim for fees (in percentage of the total rental price).

Number of guests, visitors and events

The use of the lakeside cabin is permitted only to the persons named and confirmed in the booking process.

The entry into the property and the holiday complex by unregistered persons is strictly prohibited without the prior express and written consent of the landlord. Events, celebrations, parties or other gatherings – regardless of the number of participants or the volume of noise – are categorically prohibited. Any form of visitor reception without permission constitutes a breach of contract. This also applies to short-term stays. Overnight stays by persons not booked are in any case inadmissible.

The maximum number of people allowed at any time must not be exceeded.

Sleep must be strictly observed from 22:00 onwards.

Contractual penalties and consequences

• In case of violation, an immediate contractual penalty of € 500,- per additional person and incident calculated.
• The landlord is entitled to terminate the tenancy if there is a breach of the agreement. without notice and without refund of the rental price to end.
• Payments already made will not be refunded.
• Further claims for damages are expressly reserved.
• Costs for additional cleaning, security measures or government interventions are charged separately.

The tenant is liable for all violations and damages caused by him or his accompanying persons.

Mängel und Schäden am Mietobjekt

Der Mieter verpflichtet sich, alle Mängel, alle Schäden oder Probleme mit der Energieversorgung dem Vermieter (ausgewiesen in der Buchungsbestätigung) umgehend telefonisch zu melden. Dasselbe gilt für den Verlust oder die verspätete Rückgabe der Schlüssel, in diesem Fall ist der Vermieter berechtigt, ohne weitere Rücksprache mit dem Mieter eine neue Schließanlage zu Lasten des Mieters einbauen zu lassen. Der Mieter haftet für von ihm oder Dritten in seiner Verantwortung (z.B. Begleitpersonen, Gäste und Besucher) verursachte Schäden am Mietobjekt oder abhanden gekommenen Einrichtungsgegenstände/Inventar.

Haftung für Schäden des Mieters und Dritter

Der Mieter, seine Begleiter und Besucher und die von ihnen mitgeführten Sachen sind während der Mietdauer durch den Vermieter nicht versichert, auch nicht, wenn die Ursache im Zusammenhang mit dem Mietobjekt entstanden ist. Der Vermieter übernimmt keinerlei Haftung, egal für welche Schäden. Es haftet der Mieter.

Ferienhaus Neusiedlersee mieten – Ankunft und Abreise

Der Schlüssel für das Ferienhaus wird dem Mieter bei Mietantritt mittels Schlüsselbox und Code übergeben. Während des Ferienaufenthaltes ist der Mieter für die gesicherte Aufbewahrung des Schlüssels verantwortlich. Der Gast verpflichtet sich, den Schlüssel in jedem Fall beim Auszug aus dem Ferienhaus in die Schlüsselbox zurückzugeben. Die Übernahme des Mietobjektes durch den Mieter erfolgt direkt vor Ort zum vereinbarten Mietbeginn. Das Mietobjekt kann am Tag des Mietbeginns im Zeitraum von 15:00 – 22:00 Uhr übernommen werden. Im Ferienhaus liegt eine Inventarliste aus. Diese gilt als vollständig und richtig akzeptiert, sollte nicht innerhalb des ersten Anreisetags eine gegenteilige Rückmeldung an den Vermieter erfolgen. Die Rückgabe des Mietobjektes und gegebenenfalls des Schlüssels muss am vereinbarten Abreisetag um spätestens 10:00 Uhr erfolgen. Nach Rücksprache und entsprechender Vereinbarung zwischen Mieter und oder Vermieter kann eine vorzeitige Rückgabe vereinbart werden.

Nicht in Anspruch genommene Leistungen durch den Mieter

Nimmt der Mieter aus vom Vermieter nicht zu vertretenden Gründen oder wegen höherer Gewalt Leistungen nicht in Anspruch oder bemängelt diese, so besteht kein Anspruch des Mieters auf Rückvergütung des Mietpreises, auch nicht anteilig.

Reisewarnungen für Österreich:

Die Interessenten werden ersucht, die Reisewarnungen ihrer Länder aufmerksam zu beobachten. Sollte in Ihrem Heimatstaat eine Reisewarnung für Österreich bzw. für den Neusiedlersee vorliegen und die Seehütte trotz Kenntnis dieser Reisewarnung gebucht werden, ist der vereinbarte Preis für die Nächtigungen vom Buchenden auch dann zu bezahlen, wenn der Kunde die Leistung wegen der aufrechten Reisewarnung nicht in Anspruch nimmt/nehmen kann.

Vorzeitige Auflösung des Mietvertrages

Der Vermieter ist berechtigt das vereinbarte Entgelt zu verlangen, wenn der Mieter nicht erscheint. Der Vermieter kann während des Aufenthaltes des Mieters die Mietvereinbarung ohne Rückvergütung das Mietverhältnis auflösen, wenn der Mieter, seine Begleitung oder Besucher von dem Mietgegenstand einen erheblich nachträglichen Gebrauch macht oder den Bestimmungen des Vertrages (Hausfrieden, gemeindliche und gesetzliche Vorschriften, vertragswidriger Gebrauch) trotz (auch mündlicher) Abmahnung zuwiderhandelt. Bei Auflösung des Mietvertrages aus wichtigem Grund ist der Mieter zur Zahlung des Entgelts verpflichtet. Der Vermieter wird in Abzug bringen, was er sich durch Nichtinanspruchnahme der Vermietung erspart oder was er durch andere Vermietung erhalten hat.

Haftungsausschluss des Vermieters
Der Vermieter übernimmt keinerlei Haftung, insbesondere im Falle von Leistungsstörungen oder Unmöglichkeit der Leistung. Sollte ein Teil dieser Vereinbarung unwirksam sein oder werden, wird hiervon nicht die Wirksamkeit der anderen Teile beeinträchtigt. An die Stelle der unwirksamen Teile treten Vereinbarungen, die dem Sinn des unwirksamen Teiles am ähnlichsten sind. Der Vermieter kann nicht vorhersehen, ob behördliche Maßnahmen eine Nächtigung unmöglich machen. Wir informieren Sie jedenfalls auf unserer Homepage, sobald wir Kenntnis von derartigen Verordnungen oder Gebrechen erlangen. Sollte durch behördliche Maßnahmen die gebuchte Leistung nicht durchgeführt werden können, hat der Kunde auch kein Entgelt zu zahlen. Dies gilt ab dem Zeitpunkt, wo der Vermieter von den behördlichen Maßnahmen verständigt wurde und dies auf seiner Homepage angeführt hat.

Use of the boat

The boat is part of the equipment of the rental property Ferienhaus Neusiedlersee and the tenant must treat it with the same care as the other rental property. The boat is provided to the tenant free of charge and as a voluntary additional service; it is not part of the agreed rental fee. The tenant is responsible for the boat and its crew during the boat trip in accordance with the Lake & River Traffic Regulations BGBl. No. 42/1990. The minimum age to use the electric boat is 18 years old. Use of the boat is at your own risk; standing and swinging in the boats is prohibited. Alcohol at the helm is prohibited just as in road traffic. The boat is designed for a maximum of 4 people to use. Please note the weight load of the individual boats. Parents/other guardians must fulfill the duty of supervision and are responsible for the safety of their/the children being supervised (wearing life jackets, behavior on the boat…).

Since the boat is an additional service provided free of charge, there is no entitlement to a reduction in price, replacement service or compensation if the use of the boat is not possible in whole or in part – for whatever reason, in particular due to low water levels, a technical defect, maintenance, repair or other temporary unavailability of the boat.

For any pollution of water, shore and environment caused by the tenant, the latter is also responsible and liable. Waste and litter must be taken ashore and disposed of in the designated containers. The seagrass belts, lotus ponds, marked zones for swimming and sports activities, as well as fenced-off swimming or sports areas, must not be used. The instructions of the landlord or the person acting on his behalf must be followed. The tenant is fully liable for damage to the boat or its accessories (e.g. due to improper use). The landlord is not liable for damage to third parties caused by the tenant’s use of the boat. Any damage or accidents must be reported immediately by phone; further instructions for action will be provided. Any unreported damage will be considered intentional and (also retroactively) charged. If damage is not reported, the tenant may also be held liable for consequential damages (e.g., the boats being unable to operate due to repairs). The tenant agrees to return the boats and accessories clean, fully loaded, and covered with tarpaulin, otherwise a cleaning fee may be charged. Place of performance, jurisdiction, and choice of law

Wiederrufsbelehrung

Widerrufsbelehrung für Buchungen, die direkt über unsere Website erfolgen:

• up to 60 days before the trip starts: 25% of the travel price
• from 60 to 20 days before departure: 50% of the travel price
• from 19 to 15 days before departure: 75% of the travel price
• from 14 days before the trip starts: 100% of the travel price

The rental property („Seehütte Romantika I & II“) is located in 7071 Rust, Austria.

For all disputes arising from or related to this rental agreement, the exclusive jurisdiction of the court with jurisdiction in the matter, located at the landlord’s registered office, is agreed upon – insofar as legally permissible. The sole applicable law is German law. Austrian law, excluding the rules of collision and UN sales law. The rental agreement is subject to Austrian law. The use or copying of this text, even in part, is prohibited by copyright law.
